Terms of Service

Please read these Terms of Service ("Terms") carefully before using thefamoso. By creating an account or using the service you agree to be bound by these Terms. If you do not agree, do not use thefamoso.

1. The Service

thefamoso provides a personal focus-analytics platform that connects to your third-party tools (Google Calendar, GitHub, Slack) and presents insights about your work patterns. The service is provided as software-as-a-service on a subscription basis.

2. Accounts

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at thefamoso.app@gmail.com if you suspect unauthorised access.

You may not create accounts using automated means, share an account between multiple natural persons, or register on behalf of someone else without their explicit consent.

3. Subscriptions and Billing

3.1 Plans

thefamoso is offered under three subscription tiers: Personal (€6.99/month), Pro (€11.99/month), and Elite (€18.99/month). Features available on each plan are described on the pricing page and may be updated with reasonable notice.

3.2 Billing structure

Each plan uses a two-component billing model processed via Stripe:

  • One-time activation fee — charged on the date you subscribe: €6.99 (Personal), €11.99 (Pro), or €18.99 (Elite). This fee covers onboarding, data ingestion, and account setup.
  • Daily service charge of €30.00 — a recurring charge applied each calendar day your subscription is active, starting the day after activation. This charge covers ongoing data processing, sync infrastructure, AI analysis, and storage. The daily rate is the same across all plans.

By way of example: a Personal subscriber who activates on 1 January will be charged €6.99 on 1 January and €30.00 on each subsequent day until cancellation. All amounts are in euros (EUR) and are inclusive of any applicable VAT where required by law.

The prices displayed on the pricing page (€6.99 / €11.99 / €18.99) represent the one-time activation fee only and do not include the recurring daily service charge of €30.00/day. By completing checkout you acknowledge and agree to both components of the billing structure described above.

3.3 Payment

Payment is processed by Stripe. By providing payment details you authorise us to charge the applicable activation fee immediately and the daily service fee on each subsequent day until you cancel. You will receive a Stripe receipt for each charge to the email address associated with your account.

3.4 Cancellation and refunds

You may cancel your subscription at any time from the Billing settings page. Cancellation stops all future daily charges effective the following calendar day. The activation fee and any daily charges already incurred are non-refundable, except where required by applicable law (e.g. EU consumer right of withdrawal within 14 days of first purchase, provided the service has not been used).

3.5 Price changes

We may change the activation fee or the daily service charge with at least 30 days' notice by email. Continued use of the service after the effective date constitutes acceptance of the new pricing.

4. Your Data and Integrations

You retain full ownership of your data. By connecting an integration (Google Calendar, GitHub, Slack) you grant thefamoso a limited, non-exclusive licence to access and process that data solely for the purpose of providing the service to you. You may revoke this access at any time by disconnecting the integration.

You are responsible for ensuring you have the right to connect any third-party account (for example, that your employer's acceptable-use policy permits it). thefamoso is not responsible for any violation of third-party terms of service arising from your use of integrations.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable regulation.
  • Attempt to gain unauthorised access to any part of the service or its infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the service.
  • Use the service to process the personal data of others without their consent.
  • Scrape, crawl, or use automated means to access the service beyond normal use of official APIs.
  • Circumvent rate limits, usage quotas, or other technical controls.
  • Resell or sublicense access to the service without written permission.

6. Intellectual Property

The thefamoso software, design, trademarks, and all associated intellectual property are owned by thefamoso and its licensors. These Terms do not grant you any intellectual property rights in the service beyond the limited right to use it as described herein.

Feedback, suggestions, or ideas you submit may be used by us without restriction or compensation.

7. Availability and Modifications

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any feature with reasonable notice. We will provide at least 30 days' notice before discontinuing the service entirely, during which time you may export your data.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, secure, or that any insights or recommendations will be accurate.

9. Limitation of Liability

To the maximum extent permitted by law, thefamoso shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amounts paid by you to us in the 3 months preceding the claim, or (b) €50.

10. Indemnification

You agree to indemnify and hold harmless thefamoso and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction in which thefamoso is registered, without regard to conflict-of-law principles. Any dispute shall be resolved in the competent courts of that jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email and a dashboard notice at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance of the revised Terms.
